I-9 Employment Eligibility Verification

Every new hire at UH is required to complete the I-9 Employment Eligibility Verification form with Human Resources. Section 1 of Form I-9 must be completed by the new hire on or before the first day of employment.

View the list of acceptable documents for I-9 completion. Note that each document must be un-expired and original.

Existing workers on temporary visa/status are required to update Form I-9 with Human Resources when their work authorization has been updated, renewed, or changed. 

Note for workers in J-1 and F-1 status: Individuals on F-1 and J-1 visas working on-campus are responsible to present updated I-20 or DS-2019 forms to Human Resources. Communication between HR and ISSSO is not automatic.

Notes for workers in H-1B status:

(1) Individuals already in H-1B status who have had an I-129 petition filed on their behalf for an extension of stay with the same employer may complete a new I-9 form, as the timely-filed extension application should allow the employee to continue working for the same employer for up to 240 days or until USCIS makes a decision on the petition, whichever is soonerThe employer should write “240-Day Ext.” and the date the Form I-129 petition was submitted to USCIS in the margin of Form I-9 next to Section 2.

To show that the employer filed a petition on the employee’s behalf, it is suggested that the employer retain the following documents with the employee’s existing Form I-9:

  • A copy of the new Form I-129
  • Proof of payment for filing a new Form I-129
  • Evidence that you mailed the new Form I-129 to USCIS

Employers must reverify the employee’s employment authorization in Section 3 once they receive a decision from USCIS.

(2) Individuals already in H-1B status who have had an I-129 petition filed on their behalf for a Change of Employer application for portability to a new employer, or for new concurrent employment, may present the Form I-94 indicating H-1B nonimmigrant status issued for employment with the previous employer along with his or her foreign passport as a List A document. The new employer should write “AC-21” and the date the Form I-129 petition was submitted to USCIS in the margin of Form I-9 next to Section 2.

To show that the employer filed a petition on the employee’s behalf, it is suggested that the employer retain the following documents with the employee’s existing Form I-9:

  • A copy of the new Form I-129
  • Proof of payment for filing a new Form I-129
  • Evidence that you mailed the new Form I-129 to USCIS
