  • STAC 5/F6/3 - I D - 34 Eliz - London - William Fullwood v John Gaskyn et al
    • ODNB Fulwood [Fullwood], William (d. 1593), by Cathy Shrank Fulwood himself appeared in at least four cases in the court of Star Chamber. In 1574 he was accused of conspiracy against a painter, Raphe Brooke, a case to which Fulwood returned in 1589 when he vindicated himself by publishing A Spectacle for Perjurers, printed by Alde, comprising a perjured deposition of one John Jones, whose earlier perjury had condemned Fulwood and his co-defendant, John Doughtie, in 1574. In 1580 Fulwood was charged with inducing one Henry Franckland to write his will in Fulwood's favour (despite Fulwood's apparent responsibility for Franckland's imprisonment in the Fleet). That year he was also accused of wrongfully acquiring the rents of properties in the London parish of St Sepulchre, where Fulwood dwelt in Long Lane. During the prolonged course of this case (which also involved proceedings in the court of wards, chancery, and Guildhall), Fulwood appeared before the queen's bench charged with the stabbing and attempted murder of the key witness, Thomas Walbutt, a defrocked minister castigated in Robert Crowley's Apologye or defence of those Englishe wryters and prechers which Cerberus the thre headed dog of hell chargeth with false doctryne (1566). Fulwood's hasty temper is also apparent from the fourth case brought before the Star Chamber, where in 1590 he refuted a charge of assault on London pewterer John Gaskyn. Gaskyn had been accused by Fulwood of manufacturing false-bottomed tankards, and of manhandling Fulwood's wife, Anne, daughter of the London brewer John Wood.

  • STAC 5/P42/11 - I D - 22 Eliz - London - Robert Puckle v Robert Brydges, William Lackett
    • In 1579/80, a London draper’s servant called William Lockett offered an account of the coercion that could underwrite paternalism. Lockett said that he had been pressured by his master, Robert Brydges, to depose about a debt which Brydges claimed to have paid. On multiple occasions, Lockett protested that he knew nothing about the debt in question. Brydges then told him: ‘Thow muste remember howe I saved thee oute of Brydewell, where thow shouldest have remayned had I not [helped] thee. Therefore thow muste not denye me’. After this reminder of his figurative debts and a series of beatings, Lockett agreed to depose. Brydges generously told him that he would give him a statement to memorize and the ‘leysure to learne the same’. Prior to his testimony, Brydges gave him ‘a hatt . . . to make him seame like an honest and substantiall person’. Discussing the deposition that was later called into question, Lockett remembered that he had ‘stammer[ed]’ while speaking, presumably due to some combination of nervousness and an inability to remember the exact letter of his script. His case suggests that blunt power could override prospective witnesses’ attempts to act according to their knowledge and conscience: he had, as he remembered, ‘resisted [his master] so nere as he coulde’ in his efforts to avoid testifying. - Hillary Taylor, The price of the poor’s words: social relations and the economics of deposing for one’s ‘betters’ in early modern England., Economic History Review (2018) https://doi.org/10.1111/ehr.12773 STAC 5/P50/23, William Lockett (answer).

Shard, plaintiff; Beaner and Eaton, defendants: upon the hearing of which cause it appeared great disorder to be in the plaintiff who kept ill rule and order in his house and using himself disobediently to the defendant Beaner, being then one of the constables of the precinct where the plaintiff dwelt, at such time as he and the watch were coming to their plaintiff’s house having knowledge of evil persons to be there; for this the court ordered the plaintiff to ride in a cart in the city of London, as is used in such cases of punishment, and to pay £10 fine and costs to the defendant, and the warden of the Fleet to take the plaintiff and to deliver him to the Lord Mayor of London to cause the same to be executed; vide Smith, plaintiff, versus Sir John Young et al, £100 fine, £100 cost, and £100 damages, fo. 9. • Case Book BL Harley MS 2143 fo. 60r. A misdemeanor and practice to scandalize and bring in question the name of a young gentlewoman in hope of gain at her father’s hand by the counterfeiting a note in writing purporting a promise of her and getting her hand and seal to the same under pretence that the same was but a bill of debt. Note that the counterfeiting of the note and practicing to get her hand was pardoned and yet the publication thereof punished. Attorney Rex, plaintiff; Twiste, defendant: charged with a notable practice and cozenage for that the defendant being then a boy but of 10 years old was entertained at the request of the defendant’s father by one William Cornwallis, trained him up in music, and allowed him his livery, meat, and drink and £12 a year to maintain him [fo. 60v.] and the defendant not satisfied but knowing that his said master most dearly affected one Frances Cornwallis, his daughter, being but [14] years of age, did out of a covetous and wicked disposition practise to draw his said master to give him more money and allowance, which he was persuaded his said master would yield him rather than his said daughter’s credit should be touched in the least manner, and to that end he practised with one Watson, his brother in law, to lend the same Mistress Frances 10 angels and to make a bargain with her for the repayment of the same with some advantage at the day of her marriage and for the performance thereof entreated her to give him a bill of her hand which she nothing suspecting his treachery agreed unto and subscribed it without reading it, thinking it had been but a bill of debt, but the defendants had set down briefly certain words purporting that the said Frances did thereby bind and assure herself to be at his the defendant’s disposition during her life; and that done the defendant by secret insinuations and reports and by cunning letters, laboring to bring his said master to believe that his said daughter had under her hand promised and bound herself in love to him the said defendant, and by such other means sought to urge his said master to compound with him for the said supposed promise, but upon the hearing of the cause it fell out that the defendant’s offence in counterfeiting the said note in writing and the crafty and sinister procuring the said Mistress Frances to set her hand there to was pardoned yet the court proceeded to judgment and did convict him for publishing the said note in writing and his persevering from time to time upon the same since the same pardon to effect that treacherous plot which he had before conceived by means thereof to get consideration from his said master to redeem his daughter’s slander and therefore they adjudged him to stand on the pillory at Westminster and Cheapside with a paper with a paper [sic], to be committed during the Queen’s pleasure, 1000 marks fine, and to ask the father, mother, and daughter forgeries.
