Case Book BL Harley MS 2143 fo. 47v.

Proofs. Two bills the first imperfect and yet the plaintiff admitted to use the proofs made in the first bill for the offences in the last. Nettleton, plaintiff; Twynge et al: two bills and the second bill preferred against some of the defendants in the first bill for the same offences, which was imperfectly laid in the first bill and therefore the plaintiff prayed that he might use the proofs in the first bill for proof in the second bill being but one matter in substance and varying but in form the which was ordered; a dedmius potestatem was also awarded to examine defendants who would not suffer the plaintiff to see their answers at such time as they answered by dedimus potestatem in the country.
