Annual sales tax holiday nears and other reminders

The Texas Comptroller of Public Accounts has issued a monthly newsletter reminding taxpayers that the 2016 back-to-school sales tax holiday will occur Friday, Aug. 5, through Sunday, Aug. 7.

The sales tax exemption applies to certain school supplies, clothing, shoes, and backpacks priced under $100, but textbooks, computers, and software are not exempt during this period.

The comptroller reminds taxpayers who have property in Texas damaged by the recent floods throughout the state, that they can claim an exemption from sales tax on labor charges to repair the damaged property.

With regard to the heavy equipment inventory tax, the comptroller alerts taxpayers that Tex. Admin. Code ยง 3.294 will be amended to clearly provide that a separately stated charge for property tax reimbursement is part of the taxable sales price. Until a rule amendment is adopted, sellers and purchasers can continue to follow the current policy, which allows separately stated charges for property tax reimbursement, including a separately stated Heavy Equipment Inventory Tax (HEIT) charge, to be excluded from the taxable sales price.
