Will of James Dye : 1720 - 1764

James Dye was the son of John Laurens Dey and Ann Brown (?). James married Sarah Lantz and they had 10 children.

In the name of God Amen

I James Dye of the South Ward of Perth Amboy County of Middlesex and Province of New Jersey yeoman. This first day of June Anno. Dom One thousand seven hundred and sixty one being sixk and weak in body but in perfect mind & memory calling to mind the mortality of my body & believing it is appointed for all men once to dye, do now make & ordain this my last will and testament.

Principally I first of all resigne my soul to God who gave it & my body I recommend to the Earth to be buried in a decent christian like manner at the disereshion of my Executors, believing that I shall receive the same again at the General Resurection of the Dead at the Last Day and for what worldly estate it hath pleased God to Bless me with in this Life I give Bequeath & dispose of in the following manner and form:

First I will and ordain that my funeral charges and just debts be all paid

Item: I will and ordain that all mhy personal estate be sold at publick "vandue" as soon as my Executors shall think proper after my decease except three cows & two horses & some necessary household goods and other moveables as my executors shall think proper for my wife and benefits of my wife and children to use one year.

Item: I will and orgain that my Plantatio nand all my other Personall estates be solid to the best advantage at the end of one year after my decease or soon after at the descretion of my execurors

Item: I will and ordain that my beloved wife Sarah to have the use and benefits of my dwelling house and plantation one year next after my decease towards supporting herself & my children on condition she suffers no wast of timbers.

Item: I will and ordain that after all my estate real and personall lands and moveables are sold my just debts and funeral charges paid the remainder and overplush money to be divided as follows.

Item: I will and ordain that the overplush money be divided into sixteen shares or parts and my beloved wife Sarah to have in the first place two of those parts

Item: I give and bequeath unto my sons James, Andrew, David, John and Benjamin to each of them two parts

Item: I given and bequeath unto my daughters Mercy, Rachel, Annne & Sarah to each of them one part

Item: I will and ordain that if any of my sons should dye before they arrive to age of twenty one years then the shares of the decerased to be divided among the survivors.
Item: I will and ordain that if any of my daughters should dye before they arive to the age of twenty one years or marry then their shares of the deceased to be divided among the survivors

Item: I will and ordain that my children be supported and maintained out of the Interest money arising from the overplush money and schooled at the descretion of my executors and also put out to trades and xxxx at the discretion of my executors

I hereby nominate appoint and constitute my beloved wife Sarah my Bro Vinson Dye and my friend John Tomson my executors to execute this my last will and testament

Codicil to the Will of James Dye

Whereas I James Dye of the South Ward of Perth Amboy yeoman did on the first day of June Anno Dom 1761 make and ordain in writting under my hand and seal my last Will and Testament Therefore now this Thirteenth Dday of December Anno: Dom. One Thousand eleven hundred Sixty Three, being but weak in body but of perfect mind and memory do now make and ordain this an addition and Codic il to my above said Last Will & Testament

Item: I will and ordain that all the money which now is owing comeing due and payable unto me by virtue of the Last Will and Testament of my Father John Dye deceased as part of his estate, and also any and all other money that shall be oweing coming do and payable to me & to my Estate to be all collected & received by my Executors, and as collected to be devided into sixteen hsares or parts -

Item: I give and bequeath unto Sarah my belowev wife two of those shares or parts Item: I give and bequeath unto my sons James, Andrew (insert) David John and Benjamin to each of them two of those parts

Item: I give and bequeath unto my daughters Mercy Rachel Anne and Sarah to eahc of them one of those shares

Item: I will and ordain that if anyh of my sons should dye before they arrive to the age of twenty one years or mary then the shares of the deceased to be divider among the survivors

Item: I will and ordain that if any of my daughters should dye before they arrive to the age of twenty one years of marry then the shares of the deceased to be divided among the survivors
