  • Case Book BL Harley MS 2143 fo. 45r. Actions of the case brought for matters here determined of stayed by order of the court. Acton, plaintiff; Fane, defendant. Plaintiff ordered to ask defendant’s forgiveness in an open assizes for exhibiting slanderous matter against him in his bill, the which the plaintiff performed accordingly, yet the defendant brought his action of the case against him, and recovered for the same £500 which the court upon a motion staying being for the same matters here dealt with, and the justice of assize to certify if there were any effect or disorder in the plaintiff’s behaviour in his submission. Acton, plaintiff; Foxe, defendant: the defendant discharged by writ of privilege and yet the plaintiff and his attorney prosecuted the action against him for which the court awarded a subpoena against him for which the court awarded a subpoena against them both [sic] to be examined and an injunction to stay the suit.
