Surrendered in 3 & 4 Phillip & Mary by Thomas Beale & then re-granted for the lives of the said Thomas, Agnes his wife & Robert Beale his son (father of the complt) according to the custom of the manor. Complts father now decd & complt claims as his son according to custom of the manor. Deft Worsham claims Robert Beale forfeited due to having made a demise without license, and also cutting down some trees, and thus the Lord of the manor granted the same to others in 28 Eliz. Deft Worsham has failed to prove the forfeiture & has also failed with two suits at common law to recover, thus decreed that complt to remain in possession unless & until the deft can recover at common law, or provide proof of the claimed forfeiture. Since the said decree was granted, the defts lessee has failed in a suit at Winchester Assizes against the complts tenants, therefore decreed that possession be confirmed in the complt for ever. Deft has since appealed that decree, which has been rejected and the decree ratified, and an injunction awarded against the defts for the performance of the decree
