Whereas the cause [?] in this Court by English Bill between the Right Honourable Earl of Annadale [plaintiff?] and Hugh HENN and Humphrey ROGERS and others defendants was appointed to be heard this present day for as much as upon opening of the said Bill and the defendants. Answered by Counsel learned on both sides, the Court conceived that the said Bill was exhibited by the said plaintiffs to be relieved for damages touching the not performing of certain covenants and articles of agreement made between the said parties and defendants which is more [proper?] to be tried at the Common Law. It is thereupon this day ordered by the Court that the said Bill be hereby absolutely dismissed of this Court without costs. [?] [?] [?] [end]
