SAMs in Component Executive Review for the 3rd Quarter, Fiscal Year 2017

The following SAMs have been recommended by University of Houston System subject matter experts for Executive Review.  To review the proposed changes, please select each policy name to view the linked document and send comments/suggestions, if any, to by May 19, 2017 (Friday).

The column titled "Review Comments" indicates the comments/suggestions received during the Component Draft Review, Campus Review, and the System Executive Review of the policies listed below.

SAM 01.D.07 - Anti-Discrimination Policy Changed the title from "Discrimination and Harassment Policy" to "Anti-Discrimination Policy." Added contact information in Section 2.3 about Equal Opportunity Coordinators. Added Section 2.5 on members of the University community, and Section 2.6 on pregnant and parenting students. Updated the definition of Respondent in Section 2.8, and the definition of Student in Section 2.9. Added Section 3, Jurisdiction. Added information to Section 4, Reporting. Added Section 5, Accommodating Pregnant and Parenting Students; Section 6 on Religious Accommodations; and Section 7 on Confidentiality. Added Section 9.2.5 on Resolution Agreement. Updated all Steps in Section 9, including a new Step Five (Section 9.5) on Consideration of Interim Measures and a new Step Seven (Section 9.7) on EOS Investigation. Added extensive information to Section 9.9, Sanctions. Added Section 10 on Special Provisions.

SAM 01.D.08 - Sexual Misconduct Policy Added Sexual Intimidation to Section 1.1. Updated Sexual Activity definition in
Section 2.5. Updated contact information in Section 2.8. Included Sexual Intimidation as an offense in Section 2.6; explicitly included cyberstalking in Section 6.5. Added to definition of consent in Section 4.1, and revised showing consent in Section 4.6. Added examples for Sexual Assault in Section 6.3. Added Sexual Intimidation in Section 6.5. Revised Section 7.1 on reporting to University entities. Added extensive information on reporting rights, including Sections 7.5, 7.6, and 7.7. Rearranged documentation for Section 8, Required Reporting, and Section 9, Anonymous Reporting. Added Section 10.9 on the Clery Act, and Section 10.10 on accommodations being confidential. Added medical care to prevent sexually transmitted infections and/or pregnancy in Section 12.1. Removed Cinco Ranch and added UH - Katy Campus information to Section 12.2. Added Section 12.4 on written notification of resources, and Section 12.6 on resolution agreement. Added Section 14.1.4 on opportunities to have others present to any related meeting or proceeding; and Section 14.1.8 for possible decline to pursue a complaint based on a valid claim. Added disqualification from student leadership positions in Section 14.6.2. Both parties may bring an advisor or attorney to the hearing in Section 14.9.10. Added documents and tangible evidence to Section 14.9.11.a. Updated the immunity reporting information in Section 15.1. Added employee mandatory training within thirty (30) days of hiring date and supplemental training every two years to Section 15.6.3.

SAM 02.E.09 - Reasonable Workplace Accommodations for Employees With Disabilities Added information to Section III.D on essential functions regarding physical presence at the work site. Added a Consent Form to the Step Two process in Section 6.2 as required paperwork. Added Section 6.2.D on ADA Coordinator reviewing medical paperwork provided by Licensed Health Care Practitioner, and Section 6.2.E on the possibility for employee's inability to perform essential functions. Modified Section 6.3 on process for non-receipt of documentation. Added information to Section 6.4 on the process for an independent medical opinion. Added Section 6.5.A.4 on consultation with employee's supervisor regarding potential accommodation and possible undue hardship. Added employee as receiving party to recommendation for workplace accommodation in Section 6.5.C. Added ten (10) working days for supervisor's written justification for workplace accommodation rejection in Section 6.5.E. Added ten (1) working days for alternative reasonable workplace accommodation in Section 7.C. Added Section 8 on modification of approved accommodation plan process. Added Section 10 on the rules for the effect of reasonable accommodation.

SAM 03.A.19 - Monthly Cell Phone Allowance Changed title from "Monthly Communication Allowance for Business Use of Personal Cell Phone and/or Internet Service" to "Monthly Cell Phone Allowance." Changed all sections to emphasize cell phone allowance, instead of communication allowance. Removed previous component university guideline based on current operating requirements in Section 2.3. Updated titles as applicable.

SAM 03.E.07 - Fleet Management Plan Updated links and titles as applicable. No additional redlines were required by the Subject Matter Expert (SME).
Per SAM 01.A.01, Section 7.2 on redlines received after the scheduled review date for a document, this document will receive a full review cycle.

SAM 03.F.02 - Endowment Management Added exception to Section 3.11.1 for four endowments to receive same income beneficiary cost center assignment meet the terms of the endowment agreement for distribution of income.

SAM 03.F.09 - Payments of Benefit Costs from State-Appropriated Funds
(New SAM)
This document establishes policy and procedures for ensuring compliance with State statutes, administrative regulations, and reporting requirements regarding benefits proportionality.

SAM 06.A.07 - Procedures for the Operation of Centers and Institutes Changed title to "Centers and Institutes." Added information to Section 2.1 on scholarly activities, and centers/institutes may be primarily focused on academic or research. Added Section 2.4 on identification of centers and institutes. Added Section 2.5.b for rule on non-duplication of activities for centers and institutes. Added Section 3.2, with five additional policy topics for centers and institutes. Changed review period from every three years on or before December 31st to every five years on or before September 1st.
